TERMS AND CONDITIONS CAN CHANGE DEPENDING ON THE CIRCUMSTANCES OF EACH SALE.

IT IS VERY IMPORTANT TO REVIEW THE TERMS BEFORE PARTICIPATING IN ANY AUCTION!

Auction Pick Up and Removal: Pickup Location(s) are noted on the auction and will also be on your invoice (which will be emailed upon completion of the auction). We utilize load-out BY APPOINTMENT. An invitation will be sent in your email with a link to SignUp Genius.

IMPORTANT! Many of our On-Site Auction Locations are transferring to new owners the next day so pick-up times are STRONGLY ENFORCED! Any items left after the specified load-out time will be considered forfeited unless alternate pick up or shipping arrangements are made IN ADVANCE OF THE AUCTION CLOSING.

Loadout: We do not provide loading assistance for free! Before bidding be sure to bring plenty of help at the designated pick-up time and location to remove your items. You are responsible to furnish ALL labor, carts/dollies and packaging materials. If you are unable to secure the labor or proper equipment for removal at the noted time and location then PLEASE-DO NOT BID!!!

STAGGERED/DYNAMIC CLOSING: The lots in this auction will close beginning at 6:00 pm and will be Extend One-Extend All. Which means if there is a bid on any items within 1 minute, then all the other items will remain open until there are no more bids.

The following fees WILL be charged when necessary:
*The buyer will be charged a $25 non-removal fee for any lot or partial lot left behind, as well as all disposal costs.
*The buyer will be charged $25 per lot for items we have to help remove due to buyer’s lack of preparedness.
*The buyer will be charged $50/hour if you require our staff to stay past the designated ending time.
*Repeated tardiness and/or failure to remove items will result in revocation of bidding privileges on ALL of our bidding platforms.

*BUYERS PREMIUM: A Buyer’s premium will be charged on each purchase. A buyer’s premium, an advertised percentage of the high bid or flat fee added to the high bid, will be added to the high bid and become part of the purchase amount at settlement. Buyer agrees to these provisions and will pay the applicable buyer’s premium.

SHIPPING: Shipping is available, please review important shipping notes below!

*Shipping: In the event you would like your small items shipped … please, we are not AMAZON! We do NOT provide FREE shipping.

If you do require shipping, we WILL combine lots for shipping to minimize costs unless advised otherwise. Once the items are packed, you will receive an email with the shipping quote. You must confirm that cost and then process your payment. Once it is paid in full, your items will be shipped with tracking information sent to you. We only ship to the address on file.

Note: Oversize or extremely delicate items may be taken to the local UPS store for shipment and packaging.

ALL OF OUR ONLINE AUCTIONS FEATURE BOTH A MAX BID OPTION AS WELL AS A SOFT CLOSE.

"STAGGERED ENDING" Lots will begin closing at the designated time at a set rate. Please watch the countdown timer on each lot.

“A MAX BID” may be placed on any item and the computer will bid on your behalf, thus eliminating the need to “babysit” your bids. This option is highly recommended so you do not miss out on the item you are bidding on for any reason.

“THE SOFT CLOSE” feature which means any bid received in the final minutes of the auction will auto extend bidding on that particular item or lot by 2 minutes thus allowing a backup bidder the opportunity to raise their bid. In the event you do not use the MAX BID feature and you are out bid you will be notified via e-mail or text and will have the opportunity to raise your bid.

PAYMENT: Buyer specifically waives the right to dispute or deny payment for any purchases made with a credit card. The credit card on file will be charged for your total purchases including any buyer’s premium, or stated additional fees, upon conclusion of the Auction. All denied transactions due to expiration date, insufficient funds, and/or other reasons shall be subject to a $20 re-processing fee. You can update your credit card under "PROFILE" on the website dashboard. Credit card chargebacks are not allowed.

A paid invoice will be sent to your registered e-mail address within 2 hours following the conclusion of the auction. If you do not receive an invoice, please check the dashboard under "PROFILE"-"INVOICES" You as the buyer are responsible for keeping your credit card on file and up to date.

Large ticket purchases over $2,500 or titled vehicles, MUST be settled for with CASH, wire transfer or previous arrangements made with the Auction Company. No item will be released or transferred until payment has posted to our account.

Basic Auction Terms & Conditions
Theurer Auction/Realty LLC (“TAR”) retains the right to govern goods and services sold to clients and to maintain the level and integrity of our business. TAR has the right to terminate the auction at any time; withdrawal from sale of any item; to sell at this auction items not listed; to group one or more lots into one or more selling lots or to subdivide into two lots or more selling lots. The auction company also reserves the right to sell all of the items listed in bulk.

No Liability: a) TAR assumes no liability for your purchases. The buyer assumes and does agree to indemnify and hold the auction company and seller harmless from any future claim that shall pertain to fitness or use of the asset being purchased. b) Persons attending during preview, sale or removal of goods assume all risks of damage or loss to person and property and specifically release and indemnify the Auction Company from liability therefore. Neither the Auction Company nor his principal or seller shall be liable by reason of any defect in or condition of the premises in which the sale is held.

Consignors & Bidders: a) All consignors must fill out a contract with TAR, sign forms and abide by our terms listed. b) All bidders must register for bidder's numbers using proper ID or proper information. c) No consignor, seller, or agent for seller has the right to bid on their consigned goods. d) Any employee of TAR may bid at any auction if they wish to purchase an item. e) All items become the sole responsibility of the purchaser when the auctioneer confirms your bid as the successful winner. We are not responsible for lost or stolen items.

Loss of Bidding Privileges: If you have failed to pay for an item, or failed to timely pick-up items, your bidding privileges will be revoked. Your privileges may be restored by paying for the item or repaying for the loss of the revenue due to the items not having been sold and by placing a credit card on permanent file whereby future purchases will automatically be charged.

Delinquent Accounts: The bidder that has not paid for, or has not removed their items from the auction site, will be subject to the cost of storage, trucking, re-sale, deficiency balances, collection fees, and any legal fees for recouping a loss due to the bidder's negligence.

Reserves: Any and all items that TAR agrees to sell are subject to a reserve or minimum and will be confirmed by the Seller.

Documents: a) All documents must be completed in full by buyers and sellers. For Example: Death Certificates, Letters of Authority, Creditor Liens, and UCCs when purchasing vehicles, firearms, etc. b) All firearms will be transferred by a licensed FFL dealer and shipped to an FFL (Federal Firearms License) Dealer in your area.

Compliance with the Terms of Sale: In default of payment of bills in full within the time announced for this auction the Auction Company in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages.

Warranties: Everything is sold “AS IS/WHERE IS” with no warranties, representation or guarantees expressed, implied or otherwise given. All sales are final.

Conditions of Items Sold: a) All information is believed to be accurate, but the auction company shall not be responsible for the correct description, authenticity, genuineness of or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloging or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold “as is” and without recourse. b) TAR recommends any and all buyers preview and make your own opinion of conditions.

BIDDER REGISTRATION: Bidders must be 18 years of age or older, and are required to register for the auction. In registration, Bidder must submit information found to be current, complete, and accurate for proper identification. Auctioneer does not sell or rent this information. Auctioneer uses email mailing lists to notify customers about auctions. Customers who do not wish to be notified should contact the office of the Auctioneer and request removal from the email mailing list. Bidder is responsible for security of his/her bidding number/user name and password, and any and all bids placed under the assigned number-ID. Auctioneer should be notified immediately if Bidder believes number and/or password have been compromised. Auctioneer reserves the right to terminate registration, deny any person for any reason permission or access to bid, to reject any and all bids, and to suspend or ban Bidder from bidding, at Auctioneers sole discretion. Bidder registration is not transferable or assignable.

ONLINE BIDDING INFORMATION
Bidder acknowledges that hardware malfunctions, software malfunctions, viruses, and similar issues do occur and are beyond the knowledge, scope, and control of Auctioneer. We are NOT responsible for your system malfunctions, connection to the internet or your e-mail client stopping any of our e-mails to you in regard to bid confirmations and or outbid notifications.

Theurer Auction/Realty LLC has full discretion to modify the date and time, order, and details of the auction for any reason or no reason at all, including but not limited to technical issues, emergencies, and convenience of Theurer Auction/Realty LLC or the Seller.

Your use of this site and bid placement constitutes your acceptance and agreement to adhere to these terms. Please print a copy for your records. All bidders are responsible for reading all terms and conditions carefully. Lack of knowledge of Auction Terms and Conditions will not release bidders from their obligations.

AGENCY DISCLOSURE: In all transactions, the auctioneers are acting as agents for the seller, not as buyer’s agents.

LEGAL COURSES OF ACTION: Bids are a binding offer to enter a contract and you are responsible for honoring them. Every legal remedy available will be used to ensure buyer's performance of this contract. Buyer accepts responsibility for and agrees for buyer and all of buyer's agents, representatives, successors and assigns to indemnify, defend and hold harmless sellers & Theurer Auction/Realty LLC, its employees, governing body, officers, owners, affiliates, subsidiaries, directors, agents, and representatives from and against any and all claims, losses, damages, liabilities, judgments, fees, costs, and expenses including reasonable attorneys' fees and expenses related to, arising from, or associated with (1) the sale of the property, including, but not limited to, personal injuries or property damage incurred on the sale premises or during removal and transport of any auction item, (2) buyer's use of Theurer Auction/Realty LLC website and (3) a dispute with another bidder.

Seller agrees to hold harmless the Auctioneers against any claims of the nature referred to in this contract. Venue for any controversy or claim arising from or relating to this agreement, or breach thereof, shall lie exclusively with District Court of Sumner County, Kansas. This agreement shall be interpreted in accordance with, and governed by, the laws of the State of Kansas.

WARNING! - EXPLANATION OF CREDIT CARD FRAUD: In order to bid online, buyers must register and create an account at our website, www.theurer.net. The credit card will be charged upon completion of the auction for any items won plus applicable buyer's premium. If, when charged, it is determined that the card is not valid or does not have a sufficient balance to cover the charges, and the bidder or representatives of the bidder knowingly registered with this card, this constitutes "Credit Card Fraud" under Federal and Kansas state law, and Theurer Auction/ Realty LLC, reserves the right to press criminal charges for such fraud, including the swearing out of an arrest warrant in the county of the bidder's residence. In addition to any criminal charges, Theurer Auction/Realty, LLC reserves the right to seek civil restitution.

Theurer Auction/Realty LLC reserves the right to revise The Terms and Conditions.
